Agreement to terms

By accessing or using the El Caporal Western Wear website, placing an order, or using related services, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the site.

Eligibility and accounts

You must be able to form a binding contract under applicable law to purchase from us. You are responsible for maintaining the confidentiality of any account credentials and for activity under your account or email used for order lookup.

We may refuse service, limit quantities, or cancel orders at our discretion, including in cases of suspected fraud, reseller abuse, or pricing/inventory errors.

Products, pricing, and descriptions

We strive for accurate descriptions, images, and prices, but errors may occur. Colors may vary based on display settings. We reserve the right to correct errors and to cancel or limit orders placed at an incorrect price or with incorrect availability information.

All prices are shown in U.S. dollars unless stated otherwise and exclude applicable taxes and shipping, which are calculated at checkout where required.

Orders and payment

An order submitted online is an offer to purchase. We may accept or reject the offer by confirming the order, charging payment, and/or shipping the goods. Payment is processed by third-party providers; you authorize us and our processors to charge your selected payment method for the total due.

Promotional codes (including welcome offers such as a percentage discount for new subscribers) are subject to their stated terms, may be one-time use, non-transferable, and combinable only as allowed, and may exclude certain brands, sale items, or gift cards.

Shipping, returns, and privacy

Purchases are also subject to our Shipping Policy, Returns & Refunds Policy, and Privacy Policy, which are incorporated by reference into these Terms.

Intellectual property

The site’s content, branding, logos, photography, design, and software are owned by El Caporal or its licensors and are protected by intellectual-property laws. You may not copy, scrape, reverse engineer, or commercially exploit site content without prior written permission, except for personal, non-commercial browsing and shopping.

Acceptable use

• Do not misuse the site, attempt unauthorized access, interfere with security, or overload infrastructure.
• Do not use the site for unlawful, infringing, deceptive, or harmful activity.
• Do not harvest customer data, spam, or use automated means to place abusive orders.

Disclaimer of warranties

EXCEPT WHERE PROHIBITED BY LAW, THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EL CAPORAL AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT(S) AT ISSUE IN THE TWELVE MONTHS BEFORE THE CLAIM, EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.

Indemnification

You agree to defend, indemnify, and hold harmless El Caporal and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the site, violation of these Terms, or infringement of any right of another.

Governing law and disputes

These Terms are governed by the laws of the State of TX, without regard to conflict-of-law rules, except where mandatory consumer-protection laws of your residence apply. Courts located in Fort Worth, TX shall have exclusive jurisdiction over disputes arising from these Terms or the site, unless applicable law requires otherwise.

Nothing in these Terms limits non-waivable consumer rights. If a dispute arises, please contact us first so we can try to resolve it informally.

Changes and miscellaneous

We may update these Terms by posting a revised version on this page. Continued use after changes become effective constitutes acceptance where permitted. If any provision is found unenforceable, the remaining provisions remain in effect. These Terms constitute the entire agreement regarding the site, superseding prior conflicting terms, except for specific written agreements for wholesale or custom orders.
